Who does GDPR apply to?

GDPR applies to any kind of organisation - handling data of a natural person directly or indirectly.

Private or Public Organisation

Typically, it only applies to private organisation as there is a general exception to GDPR where other legislation requires the organisation to store and keep data. However, other legislation do not cancel GDPR as such, but only allow the organisation to store data on the specific subject and the specific time specified by the specific legislation.

Exceptions

Therefore, GDPR only allows organisations to store for instance accounting data for the limited time required by the accounting laws, and only the specific data required to comply with the accounting laws.

Also, GDPR still applies to public organisations for subjects not covered by the law allowing the public organisation to store specific data. It could for instance be payment information.

GDPR is not limited to private companies. It also applies to member organisations, associations, non-governmental organisations, etc.
